“Mahere Convicted Of Breaking A Law That Doesn’t Exist”

Journalist and filmmaker Hopewell Chin’ono said that Harare lawyer Fadzayi Mahere has been convicted of breaking a law that doesn’t exist.

 

Mahere was on Wednesday, 05 April 2023, convicted of charges of publishing falsehoods prejudicial to the State by a Harare magistrate.

Mahere, who is also the Citizens Coalition for Change (CCC) spokesperson, was found guilty by Harare Regional Magistrate Taurai Manuwere after a full trial.

Posting on Twitter, Chin’ono said he was arrested the same week as Mahere and his lawyer Harrison Nkomo went to the High Court to challenge the charge. He wrote:

I was arrested the same week as Fadzayi Mahere and accused of having done the same thing and charged under the same law.

My lawyer Harrison Nkomo went to the High Court to challenge the charge on the basis that the law being used didn’t exist.

The High Court agreed & quashed it.

Mahere allegedly tweeted that a baton-wielding police officer enforcing COVID-19 lockdown regulations had fatally struck one Rebecca Musariri’s child in Harare.

The Zimbabwe Republic Police (ZRP) refuted the claim and said the child was not killed.

A video of the incident went viral in 2020, with the mother clinging to a police officer claiming he had killed her baby.
